These Terms of Agreement (“Terms”) govern your access to and use of the Esotoria website, apps, courses, coding tools, quizzes, projects, dashboards, and related services (collectively, the “Services”), operated by Esotoria (“Esotoria,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

If you are a parent, guardian, teacher, school, or other adult creating or managing access for a child, you agree to these Terms on behalf of yourself and, where applicable, the child user under your supervision.


1. Eligibility

You may use the Services only if you are legally able to enter into this agreement, or if you are a child using the Services through a parent, guardian, teacher, school, or other authorized adult.

If required by applicable law, children must use Esotoria only with appropriate parental, guardian, or school approval.


2. Description of Services

Esotoria provides educational content and interactive tools designed to help users learn practical digital skills, including but not limited to coding, AI, web development, design, quizzes, creative projects, certificates, and related educational features.

We may improve, modify, add, suspend, or discontinue parts of the Services at any time.


3. Accounts

To use certain features, you may need to create an account. You agree to provide accurate information and to keep it updated.

You are responsible for:

  • Maintaining the confidentiality of your login credentials;
  • All activity under your account;
  • Ensuring that child access is appropriately supervised where applicable.

You must notify us promptly if you believe your account has been accessed without authorization.


4. Parent, Guardian, Teacher, and School Responsibilities

If you create, manage, purchase, or supervise an account for a child, you are responsible for:

  • Providing any permissions or consents required by applicable law;
  • Supervising the child’s use of the Services when appropriate;
  • Ensuring the information provided is accurate;
  • Reviewing progress, content, and account settings where relevant.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful, harmful, abusive, fraudulent, or deceptive purpose;
  • Attempt to gain unauthorized access to any system, account, or data;
  • Copy, scrape, reverse engineer, or exploit the Services except as permitted by law;
  • Upload or share malicious code, viruses, or harmful content;
  • Use the Services to harass, bully, threaten, or harm others;
  • Impersonate another person or misrepresent your affiliation;
  • Interfere with the operation, performance, or security of the Services;
  • Use the Services in a way that violates the rights of children, users, educators, or third parties.

6. Educational Purpose Only

Esotoria is intended for educational and informational use. While we aim to provide useful and engaging content, we do not guarantee that the Services will meet any specific educational outcome, exam result, or performance goal.


7. User Content

Users may create, upload, save, submit, or display content through the Services, such as code, quiz answers, projects, images, text, certificates, progress records, or other materials (“User Content”).

You retain ownership of your User Content, but by submitting or storing it through Esotoria, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, and use that content as necessary to operate, improve, secure, and provide the Services.

You represent that you have the right to submit such content and that it does not violate any law or the rights of others.


8. Intellectual Property

Except for User Content owned by users, all content, software, branding, logos, lesson structures, graphics, text, design, and functionality within Esotoria are owned by or licensed to Esotoria and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publicly display, sell, sublicense, or create derivative works from the Services unless we give you written permission.


9. Subscriptions, Payments, and Billing

Some parts of the Services may require payment, subscription, or a paid plan. By purchasing a plan, you agree to pay the applicable fees shown at the time of purchase.

Unless otherwise stated:

  • Fees are billed in advance;
  • Subscriptions may renew automatically until cancelled;
  • You are responsible for applicable taxes, charges, or currency conversion fees;
  • Prices may change in the future, but changes will not apply retroactively.

Refunds, if any, are governed by the applicable payment provider rules and our posted refund policy, if available.


10. Trial Access and Promotional Offers

We may offer free trials, discounts, promo codes, school access, or promotional campaigns. Such offers may be limited, withdrawn, or modified at our discretion and may be subject to additional conditions.


11. Termination and Suspension

We may suspend, restrict, or terminate access to the Services at any time if:

  • You violate these Terms;
  • We believe there is a security risk, fraud risk, or risk of harm;
  • We are required to do so by law;
  • Your subscription expires or payment fails;
  • We discontinue the relevant part of the Services.

You may stop using the Services at any time. You may also request account deletion by contacting us.


12. Availability

We aim to keep the Services available and functioning well, but we do not guarantee uninterrupted, error-free, or always-available service. Maintenance, internet issues, hosting problems, updates, or technical failures may affect availability.


13. Third-Party Services

The Services may integrate with or link to third-party tools, platforms, content providers, payment processors, video services, analytics providers, or external websites. We are not responsible for the content, policies, availability, or conduct of those third parties.


14. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or reliability.


15. Limitation of Liability

To the maximum extent permitted by law, Esotoria and its founders, employees, contractors, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or related to the use of or inability to use the Services.

To the extent permitted by law, our total liability for any claim arising from the Services shall not exceed the amount paid by you to us for the Services during the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (€100), whichever is greater.


16. Indemnification

You agree to defend, indemnify, and hold harmless Esotoria and its affiliates, officers, employees, and contractors from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your violation of any law or third-party rights;
  • User Content you submit or actions you take through the Services.

17. Privacy

Your use of the Services is also governed by our Privacy Policy, which forms part of these Terms.


18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice through the website, app, or email where appropriate. Continued use of the Services after updated Terms become effective means you accept the revised Terms.
